Please read these Terms of Service carefully before using GameDesignerX. They govern your access to and use of our platform.
1. Acceptance of Terms
By creating an account or using GameDesignerX (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes are posted constitutes acceptance of the revised Terms.
2. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must be at least 16 years old to use the Service. Notify us immediately at support@gamedesignerx.com if you suspect unauthorized access.
3. Acceptable Use
You agree not to: (a) upload or share content that is unlawful, infringing, defamatory, or harmful; (b) attempt to gain unauthorized access to any part of the Service or its infrastructure; (c) use automated tools to scrape or harvest data; (d) resell or sublicense the Service without written permission; (e) interfere with the operation of the Service or other users' enjoyment of it.
4. Your Content
You retain all ownership rights to the game design documents, text, images, and other materials you create or upload ("Your Content"). By using the Service you grant us a limited, non-exclusive license to store and display Your Content solely to provide the Service. We do not claim ownership of Your Content and will not share it with third parties except as required to operate the Service or as required by law.
5. Intellectual Property
All intellectual property in the Service itself — including the software, interface, trademarks, and documentation — belongs to GameDesignerX or its licensors. Nothing in these Terms transfers any such rights to you. You may not copy, modify, or create derivative works of the Service without our express written consent.
6. Subscription & Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except where required by law or stated otherwise. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account. Taxes may apply depending on your location.
7. Free Trial
Paid plans may include a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends. We will notify you before billing begins.
8. Termination
You may cancel your account at any time from your account settings. We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or remain inactive for extended periods. Upon termination, your right to access the Service ceases; Your Content may be deleted after a grace period.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.
10. Limitation of Liability
To the maximum extent permitted by applicable law, GameDesignerX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or relating to your use of the Service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods and without regard to conflict-of-law principles. Any disputes shall be resolved by the competent courts of Germany. Mandatory consumer-protection rights under the law of your country of residence remain unaffected.
